An Overview of Regulatory Frameworks for Social Justice: A Comparative Study of Inclusive Policies in Asia and Africa

La justice sociale devient une valeur centrale dans l'élaboration de politiques réglementaires et de politiques inclusives tant en Asie qu'en Afrique. Bien que les deux régions partagent des objectifs communs d'égalité et de développement durable, elles présentent des modèles différents dans la façon dont elles formulent et appliquent des réglementations inclusives. Cet article examine les régimes réglementaires qui soutiennent la justice sociale en Asie et en Afrique, en se concentrant sur leurs aspects juridiques, institutionnels et politiques. L'article adopte une analyse comparative des politiques et du droit à partir d'études de cas sélectionnées : Afrique du Sud, Kenya, Inde et Indonésie. Les résultats suggèrent que, même si ces deux régions disposent d'engagements constitutionnels et législatifs solides en faveur de la justice sociale, des défis subsistent dans la mise en œuvre, la répartition des ressources et la gouvernance participative. L'Asie a accompli de grands progrès en matière d'action positive, de protection sociale et d'inclusion numérique, tandis que l'Afrique a été en tête dans l'ancrage des droits socio-économiques et des structures régionales dans les constitutions et l'Union africaine. Dans les deux cas, cependant, des écarts existent entre les politiques telles qu'elles sont prévues et la situation réelle, généralement exacerbés par l'inégalité, l'instabilité politique et la faible capacité institutionnelle. L'article conclut que la convergence des réglementations, davantage de mécanismes d'application et des structures participatives inclusives sont nécessaires pour promouvoir la justice sociale sur les deux continents. Il préconise un échange réciproque d'éducation entre l'Asie et l'Afrique, notamment sur les questions d'activisme judiciaire, de transformation numérique et d'autonomisation des communautés locales.
